Terms of Sale

By proceeding and completing a transaction with Timbrell Cockburn Cunha© and any/all of its associated stores, you are knowingly and fully accepting and agreeing to the terms and policies of Timbrell Cockburn Cunha©, as well as all of its subsidiaries. By proceeding as stated, you are accepting all of the terms and policies stated below and you are strongly urged to read through these policies prior to proceeding/completing a transaction; you are taken as having done so, as is permitted by law, when you accept these terms and policies by proceeding with or completing a transaction. In relation to all vintage clothing, as these are vintage pieces they will be sold as they are and may contain minor blemishes and no more, as this store takes every effort to bring you only the best possible items. All clothing and items, unless otherwise listed, are custom manufactured and/or made to a specific size, or made to order in accordance with the customer's measurements. It is the customer's responsibility to ensure that all proper measurements have been provided; failure to provide accurate measurements may result in ill-fitting clothing. As a private enterprise, all purchases are exempt from the associated EU Directives, where they apply.

 

Refunds, Exchanges and Returns

According to UK, EU, Canada and United States consumer legislation, Timbrell Cockburn Cunha© excludes responsibility for returns, refunds and exchanges as these are highly unique, rare and often custom/bespoke items bringing with them protection under such legislation. Customers must use one of our recommended shipping methods if they would like to seek a higher degree of protection, in the case of a failure on the part of a postal service. Though Timbrell Cockburn Cunha© will do everything in its power to arrange compensation where possible with insurance and compensation coverage provided through the Royal Mail®/Canada Post®/US Postal Service®, this cannot be guaranteed and will depend on a case by case, fact by fact basis. In extreme cases we may be contacted to deal with a case on a single basis (as anomalies do arise), but this is only in rare cases and does not mean that you will be granted one of these outcomes, nor does it act against our ability to exclude such options as stated in our policy and terms of service. It is necessary that you take every effort to ensure that you are the correct size for the item being purchased, or that you are sure that you would like to purchase this item for other reasons or as a gift prior to purchasing an item. All measurements are taken with the garment lying flat and have not been doubled for full circumference. To figure out if a garment will fit you correctly, measure one of your own pieces that will be a similar fit while lying flat. Where standard sizes are given, please note that the sizes stated by the original manufactures in the case of vintage clothing, that these measurements are based on their locality and the time from which these items came; as sizing changes over time, you might not be the same size in a 1950's piece as you would be in a modern garment, but all of our measurements are taken by us and guaranteed as accurate. All clothing and items, unless otherwise listed, are custom manufactured and/or made to a specific size, or made to order in accordance with the customer's measurements. It is the customer's responsibility to ensure that all proper measurements have been provided; failure to provide accurate measurements may result in ill-fitting clothing. Payment

All payments must be made in full (the price of the item in addition to the shipping price) at the time of purchase and payment must be made through one of our confirmed payment methods. Exceptions will not be made, as to secure the transaction for ourselves and for the buyer. Failure to pay within three days will result in the buyer being reported to the relevant authority and any adjoined services; the buyer will also be blacklisted and will not be able to purchase or request custom orders with Timbrell Cockburn Cunha© in the future. Failure to pay within the three day period will result in the the buyer being contacted and failure to respond along with a failure to provide immediate payment will result in a cancellation of the sale, negative feedback and the buyer being reported; failure to pay is a breach of contract and can result in civil litigation and may be deemed as fraud which is punishable as a criminal offence.Edit

 

Shipping

All orders will be shipped using services available through the Canada Post®, as to save customers on the cost of shipping all items shipped outside of Canada with a value of, or in excess of $50.00 may be delivered through Canada Post Registered Mail®, while all orders shipped within Canada will be shipped with Canada Post Regular Mai/Package Services®. This is merely the default shipping method as to save customers a substantial amount of money on the cost of shipping, WE HIGHLY RECOMMEND AND URGE ALL CUSTOMER when possible, to contact us for a shipping method of superior quality as these services (as is the case for most services such as with Canada Post® and US Mail®) do not provide a tracking number by default. If you would like a service with a tracking number and a greater level of insurance, we will ship domestic packages through the Canada Post Registered Mail® service, a service with a tracking number, higher insurance and signing upon receipt of the product. These services incur a substantial increase in price, so they are not used as a default services, but are HIGHLY recommended for orders of a substantial value. For combined shipping, please contact Timbrell Cockburn Cunha© for more information, as this service is available and happily provided. Timbrell Cockburn Cunha© does not claim and excludes where applicable responsibility for missing and damaged items due to postal services, as all items are delivered in the condition described and shown in all postings (documented through the use of photography prior to dispatch). We strongly urge all customers with any concerns about shipping and e-commerce to contact us for one of the recommended shipping services. If items fail to arrive due to issues on the part of your mail provider, we will attempt to recover all costs from the associated mail service and all its counterparts abroad, but this, as is the case with all services and stores, cannot be guaranteed as often this is due to incorrect addresses being provided by buyers and local postal services failing to uphold a high standard of service. All orders will be shipped to the exact address provided by buyers at the time of purchase, your addresses will be copied and pasted as they are with little or no editing (only where it is necessary for formatting as to fit the necessary postal tag) to the addresses as they are found on receipt from the buyer. ENSURE all addresses are valid and accurate prior to the completion of your transaction; if you are unsure, please contact Timbrell Cockburn Cunha© or your local mail service prior to ordering. All items will be posted during the next full business day.

Timbrell Cockburn Cunha© is now a copyrighted brand and and afforded protection under the Berne Convention. All intellectual property belonging to other parties is handled by those bodies and is theirs to limit or make use of as they see fit; these terms exist in relation to Timbrell Cockburn Cunha© and its bodies. All designs, information and writings distributed by Timbrell Cockburn Cunha© are copy written under international agreements and local law as the original product of an artist and are protected in all regions by international agreement and treaty. We reserve all rights over our property and do not consent to its use in any way what so ever, with the exception of manners laid out in contract with Timbrell Cockburn Cunha© and its founder. Timbrell Cockburn Cunha© is more than happy to take and fulfil custom orders where and whenever possible as long as we are contacted prior to any transaction and agree to the terms set forth by the individual requesting the order. We offer many different services, from complete bespoke pieces (such as wedding dresses, corsets, uniforms, head-wear, male and female shirts, jackets, coats, gloves and so on) to seeking and searching for specific vintage pieces, historical items and the research and production of unique/custom historically based items and clothing. We are more than capable of creating items from your measurements into a specific block for you and then proceeding to a pattern and a finished piece meeting your every need. When entering into such an arrangement, you agree to allowing Timbrell Cockburn Cunha© and all of its incarnations to take the time necessary within reason to complete your piece (as will be quoted to you) and that you will provide all compensation necessary for the creation of the item as agreed to prior to the commencement of the project. We are more than willing to engage in any such endeavour and encourage customers to make use of this unique and varied service when and as often as they chose to.
